TERMS OF SERVICE

1. Introduction and Agreement

These Terms of Service ("Terms") are a legally binding agreement between you and House And Land Packages Pty Ltd (ABN 92 631 641 408) ("HALP", "we", "us", or "our"). By accessing or using any HALP website, platform or service you agree to be bound by these Terms.

For advertisers (agents, builders and developers), these Terms also incorporate the Listing Agreement by reference. If there is any inconsistency regarding listing specifics, the Listing Agreement prevails.

These Terms apply to all HALP platforms including www.halp.com.au, www.boutiquedevelopments.com.au, associated mobile applications and any related websites, features or services within our network.

You must be at least 18 years of age and have authority to enter this agreement. We may modify these Terms at any time; the "Last Updated" date will be updated, registered users notified by email and material changes prominently displayed. Continued use after changes constitutes acceptance.

2. Description of Services

HALP operates property discovery and business directory platforms including house & land package listings, off-the-plan and new development information, boutique and luxury property showcases, school-zone integration, calculators, mortgage broker connections and market insights.

We also provide business directory services (freemium listings, premium visibility, lead generation, business profile management) and supporting services including alerts, saved searches, calculators, educational content and CRM integration.

Nature of service: HALP is an information and advertising platform. We facilitate connections but are not a real estate agent, developer, builder or financial advisor. We do not act as your agent, provide advice, or guarantee accuracy of third-party listings.

Service availability: provided "as is" and "as available"; scheduled maintenance may cause interruptions. Our infrastructure includes Amazon Web Services (hosting, backups), Synergywholesale (domain), Google Workspace, Stripe, Pipedrive, ActiveCampaign and Zapier.

3. User Accounts and Registration

You must provide accurate, current and complete information, keep your credentials secure, be at least 18 and hold a valid ABN/ACN for business accounts. You are responsible for all activities under your account. We may suspend or terminate accounts for breaches, false information, fraud, non-payment or inactivity. You may terminate at support@halp.com.au.

4. User Conduct and Prohibited Activities

You agree to comply with laws, provide accurate information, respect intellectual property and act in good faith.

Prohibited: automated scraping, interfering with platform functionality, unauthorised access, false or deceptive information, viruses or malware, spam, phishing, impersonation, illegal activities, IP infringement, fraud, harassment, discrimination, unauthorised resale, competing use, aggregation for competing platforms and multiple accounts to circumvent restrictions.

Violations may result in suspension, termination, content removal, legal action and reporting to authorities.

5. Property Listings and Information

Listings are provided by developers, builders, agents and third-party data providers. HALP does not own, verify or endorse listings, and does not guarantee availability or pricing.

Property information may change without notice; prices, availability and specifications are subject to change; images may not reflect the final product; land sizes are approximate; school zone information is provided for reference only. Always verify critical information directly with the property provider.

School zone data is sourced from government and third-party providers and is provided "as is". Always verify catchments with the relevant education department and the specific school. Enrolment is not guaranteed by residing in a catchment.

6. Business Directory Listings

Advertisers must hold a valid ABN/ACN, comply with applicable laws, provide accurate information and hold necessary licences. Listings must accurately describe services, include current contact details, use owned marks, comply with Australian Consumer Law and avoid misleading claims.

Free listings provide basic directory presence. Premium subscriptions provide enhanced visibility and features, are billed monthly or annually and auto-renew unless cancelled. We may remove or suspend listings that breach these Terms, fail to pay fees, or receive credible complaints.

Advertisers must respond promptly and professionally to inquiries and comply with privacy law.

7. Payment Terms (Advertiser Subscriptions)

Pricing is displayed on our website and/or at checkout, or in the applicable Listing Agreement. Subject to change with 30 days notice. All fees are in Australian Dollars (AUD), exclusive of GST unless otherwise stated.

Payments are processed via Stripe (PCI-DSS Level 1 certified). Complete card numbers are not stored on HALP servers. Subscriptions auto-renew; failed payments may result in suspension or listing removal.

Cancellations take effect at the end of the current billing period. No refunds for voluntary cancellations. Pro-rata refunds for technical issues preventing service access, processed within 14 business days.

8. Intellectual Property Rights

All content and materials on our platforms are owned by HALP or licensed to us, including trademarks ("HALP", "House And Land Packages", "Boutique Developments"), design, software, text, graphics, data compilations and school-zone aggregations.

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use our platforms for personal, non-commercial purposes. You may not reproduce, distribute, modify or commercially exploit our content.

When you submit content (reviews, testimonials, forum posts) you retain ownership and grant us a worldwide, royalty-free licence to use, reproduce, modify and display it.

9. Disclaimers and Limitations

No professional advice. HALP does not provide financial, mortgage, investment, legal, tax or real estate advice. Calculators and tools provide estimates only. Consult qualified professionals for advice.

We facilitate connections but do not control third parties, guarantee their quality or become a party to your contracts with them.

Information may contain errors or become outdated. We do not guarantee continuous, uninterrupted or error-free service, and rely on third-party infrastructure including Amazon Web Services and Stripe.

10. Limitation of Liability

To the maximum extent permitted by law, HALP is not liable for direct, indirect, consequential, incidental, special or punitive damages arising from your use of our services, errors or omissions, third-party conduct, unauthorised account access, service interruptions or property transactions.

Where liability cannot be excluded, total liability is capped at $100 AUD for free services, and for paid services at the lesser of $1,000 AUD or the amount you paid in the prior 12 months.

Nothing excludes rights under the Australian Consumer Law. Where consumer guarantees apply, our liability for breach is limited (at our option) to re-supplying services or paying the cost of re-supply.

You agree to indemnify HALP for claims arising from your breach of these Terms, violations of law or third-party rights, use of our services, content you submit or interactions with other users.

11. Dispute Resolution

Before legal action, contact legal@halp.com.au with details and allow 30 days for informal resolution.

These Terms are governed by the laws of New South Wales, Australia, with exclusive jurisdiction of NSW courts. Optional arbitration in Sydney under ADRA rules is available. Class actions are waived to the extent permitted by law. Either party may seek injunctive relief for IP infringement, confidentiality breaches, prohibited activities or irreparable harm.

Property listing inquiries route directly to the listing agent. HALP is a technology conduit and does not store, read or process these inquiries. The advertiser becomes the data controller.

Platform inquiries (Contact Us, Join Us, Advertise With Us) are collected and managed by HALP in Pipedrive/ActiveCampaign per our Privacy Policy.

12. General Provisions

These Terms, together with our Privacy Policy, constitute the entire agreement. If any provision is invalid it will be limited or eliminated to the minimum extent necessary; the remainder continues in effect. Failure to enforce is not a waiver. You may not assign these Terms without our written consent; we may assign to an affiliate or successor. Notices to you may be sent by email, website posting or in-app; legal notices to us go to legal@halp.com.au or 235 Glen Huntly Road, Elsternwick VIC 3185. The English version prevails.

13. Special Terms for Specific Services

Mortgage calculators provide estimates only, not pre-approvals; use average rates and standard assumptions and should not replace professional advice.

School-zone data is aggregated from public government databases and provided "as is". Boundaries change frequently — verify with education departments and schools. Enrolment is not guaranteed by residing in a catchment.

Property alerts — by subscribing you consent to email and SMS notifications; you can modify or cancel anytime.

Home loan referrals — we may receive referral fees. Brokers are independent, licensed third parties; we do not guarantee approval.
